Agenda:

A supervisor is a subordinate. An employee attends a company sponsored "happy hour" and on the way home is cited for a DUI. A deputy sheriff engages in explicit, off-duty conduct on a porn site. An employee criticizes the company on his blog. What off-duty conduct can and should the employer regulate? Adivisng employers who are faced with these and other off-the-job activities involves shades of gray, particularly when the conduct at issue is entirely lawful. This discussion will highlight the legal limits restricting employers in regulating off-duty conduct and offer practical advice on how to balance legitimate business needs with employee privacy.
