Discipline of public employees can be a complicated, and often frustrating process. Regardless of whether or not the employee is represented by a union, the process that most public employees are due, and the just cause protections that exist in most public sector work settings, can lead to prolonged processes, business interruptions, significant expense and sometimes less than satisfactory outcomes.
This symposium will provide tools to be effective, minimize the risk of an unsuccessful outcome, and increase the chance of success in the discipline process.
Our symposium will be a partnership with investigative and forensic computer experts who have assisted our attorneys and clients during the various stages of the discipline process. The program will evaluate a complex set of facts, which will be the focus of an interactive discussion of ways to best manage the discipline process from start to finish. We will focus on each of the specific stages of the process, including:
- Disciplinary procedures and the alternative ways to satisfy due process requirements;
- Proper documentation, notices, and recent changes regarding the Fair Credit Reporting Act rules related to disciplinary investigations;
- Effective investigation techniques, and the potential benefits of using consultants to assist with that process in particular circumstances;
- Apropriate penalties which will promote behavioral change and withstand challenge;
- Effective resignation and/or severance in lieu of termination;
- Effective communication of the disciplinary decision to the employee, the workforce, and the media; and
- Strategies to win at arbitration

David Marosi and Roger Morse , investigative consultants from Business Risks, Inc., will participate in our program to show you how an outside investigative consultant can save you money, and assist with reaching an effective, efficient and complete conclusion to complex disciplinary matters.
Representatives from New Technologies, Inc., an internationally recognized company which specializes in computer forensics and electronic discovery related areas, will review additional considerations involved in investigations, with an electronic information component.
Arbitrators Nancy Brown, Howell Lankford and Ross Runkel, arbitrators of national prominence, will participate in a panel presentation which focuses on what matters most to arbitrators in disciplinary cases. |
